Andi Adam Faturahman, Jakarta – Two judges from the Constitutional Court, Saldi Isra and Arsul Sani, have been reported to the Constitutional Court Ethics Council (MKMK) by the Gibran 08 Nusantara Militant Volunteer group. Saldi and Arsul were reported over alleged violations of judicial ethics and codes of conduct.
The report was filed by Muhammad Rullyandi, a member of the volunteer group who testified as an expert witness in the 2024 presidential election dispute hearing at the Constitutional Court. The trial centered on the validity of the educational credentials Gibran Rakabuming Raka submitted for his vice-presidential nomination.
"I submitted the report [to the MKMK] and it was accepted by the MKMK Secretariat on Friday, October 2, 2026, at 2:50 p.m. WIB," Rullyandi said on Saturday, October 3, 2026.
The ethics report was submitted a day after Rullyandi was ejected from the evidentiary hearing. At the time, Rullyandi was appearing as an expert witness representing the relevant parties.
Rullyandi stated that Saldi Isra was reported for allegedly violating core principles of judicial power, specifically the right of all parties to a fair hearing. He also accused Saldi of infringing upon academic freedom by pressing him to retract a statement calling the election dispute hearing illegal. Meanwhile, Arsul Sani was reported over alleged bias displayed while questioning Rullyandi's arguments.
"This is an act that undermines constitutional norms," Rullyandi said.
In addition to Saldi and Arsul, he noted that a separate complaint was lodged against Constitutional Court Chief Justice Suhartoyo. He cited Suhartoyo's decision to proceed with the election dispute hearing, which he considers unlawful. Furthermore, Rullyandi challenged the legal standing of Chief Justice Suhartoyo, who was previously sued in the State Administrative Court.
"I filed that report on October 1, 2026, at 10:01 a.m. WIB," said Rullyandi, who lectures at Jayabaya University.
Tempo sought clarification from the Constitutional Court regarding the ethics reports through its Head of Public Relations and Protocol Bureau, Pan Mohamad Faiz Kusuma Wijaya. However, Faiz had not responded to Tempo's request for comment by the time of publication.
During the hearing on Thursday, October 1, 2026, Saldi Isra ordered Rullyandi's ejection from the courtroom. The judge called out remarks Rullyandi made on a talk show labeling the election dispute trial over Gibran's credentials as illegal. Saldi demanded that Rullyandi retract the statement, a demand the witness complied with.
However, the court ultimately decided to accept Rullyandi's expert testimony solely in written form. "You cannot present oral testimony. Thank you, you cannot convey anything else," Saldi told him.
The presidential election dispute lawsuit, registered under Case No. 01/PHPU.PRES-XXIV/2026, was brought by former Deputy Minister of Law and Human Rights Denny Indrayana alongside 11 co-petitioners. The petitioners contest the legitimacy of the educational documents Gibran used to qualify for his 2024 vice-presidential candidacy.
